ACFS Port Logistics has been placed in external administration.
The development follows a number of applications to wind up the business including by the Australian Taxation Office (ATO).
Speaking to Daily Cargo News, managing director Arthur Tzaneros said they were “still looking at paying the ATO in full”, albeit they were seeking clarification on what was required to have the administrator removed.
“We have got the funds to pay the ATO, so we then have to go back to the funder and say… ‘what is your position’?
“It is frustrating because we have the funds and the approvals to replace the current funder, but the current funder wasn’t willing to wait.”
Mr Tzaneros reiterated that the business is profitable.
“It has more than sufficient assets to support the business and its debts,” he said.
“It will be operating as a going concern there’s no doubt about that.”
As reported by DCN, plaintiff applications in the Federal Court for wind-up notices were scheduled for this week.
These included one from Evolution MIT Services Pty Ltd (in its capacity as trustee for the A-Star Bigfoot Logistics) and one lodged with the Federal Court by the Deputy Commissioner of Taxation.
An earlier application by Transurban was withdrawn after the two companies reached a "last-minute deal".
Media reports have suggested the debt to the ATO was in the order of $60 million.
